Welcome to Gjethe. These Terms of Service govern your use of our website and services. By accessing gjethe.com or working with us, you agree to be bound by these terms. Please read them carefully.

1. Introduction & Acceptance

These Terms of Service ("Terms") form an agreement between you ("Client", "you") and Gjethe ("we", "us", "our"), a software development company based in Prishtina, Kosovo. By using our website or engaging our services, you confirm that you have read, understood, and agree to these Terms.

2. Services We Provide

Gjethe offers a range of digital services, including but not limited to:

• Website development, mobile app development, and web application development.
• Google Chrome extension development, Python automation, and API integrations.
• UI/UX design, graphic design, video editing, and motion graphics.
• SEO optimization, Google Ads and Meta Ads management.

3. Free Consultation

We offer a free first consultation to discuss your project. This consultation is provided without obligation and does not create a contract between us. Any information you share is treated with strict confidentiality.

4. Project Agreements & Scope

All projects are governed by a separate written agreement (proposal, contract, or statement of work) that defines the specific scope, deliverables, timeline, and price. In case of any conflict between these Terms and a signed project agreement, the project agreement takes precedence.

• Any work beyond the agreed scope may incur additional costs and time.
• Changes to the agreed scope must be communicated and approved in writing.
• You are responsible for providing timely feedback, content, and materials needed to complete the project.

5. Payment Terms

Payment terms will be defined in your individual project agreement. Typically, we require a deposit before work begins, with the remaining balance due upon delivery or according to agreed milestones. Late payments may delay delivery or incur additional fees. All prices are exclusive of taxes unless stated otherwise.

6. Delivery Timelines

We aim to deliver on the timelines communicated (typically 1-2 weeks for websites, 2-4 weeks for mobile apps and web applications, and 1-2 weeks for Chrome extensions). Timelines depend on the timely provision of content, feedback, and approvals from your side. Delays caused by the Client may extend the delivery date.

7. Intellectual Property

Once full payment is received, ownership of the final deliverables (such as the website design, source code, and content produced for you) is transferred to you. We retain the right to display the completed work in our portfolio and use it for promotional purposes, unless otherwise agreed in writing. Any third-party tools, libraries, or assets used remain the property of their respective owners.

8. Confidentiality

We treat all Client information, project details, and shared materials as confidential. We do not disclose your information to third parties without your permission, except as required by law. Upon request, we are happy to sign a Non-Disclosure Agreement (NDA) before receiving sensitive project details.

9. Warranties & Disclaimers

We deliver our services with reasonable skill and care. However, we do not guarantee specific business outcomes such as sales, rankings, or traffic. Our services are provided "as is" without any additional warranties beyond what is required by law.

10. Limitation of Liability

To the fullest extent permitted by law, Gjethe shall not be liable for indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability under any project shall not exceed the total amount paid by you for that specific project.

11. Termination

Either party may terminate a project agreement in accordance with the terms defined in that agreement. If a project is terminated by the Client mid-way, you agree to pay for all work completed up to the termination date. Any deposits paid are non-refundable unless otherwise agreed in writing.

12. Governing Law

These Terms are governed by the laws of the Republic of Kosovo. Any disputes arising from these Terms or the use of our services shall be resolved in the competent courts of Prishtina, Kosovo, unless otherwise agreed in writing.
